These Terms of Use govern access to and use of elvanacare.com.au (the “Site”), operated by Elvana Care Proprietary Limited trading as Elvana Care (“Elvana Care”, “we”, “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About This Site
This Site provides general information about Elvana Care and its aged care services, and allows visitors to make enquiries or request support through our Enquiry and Get Started forms. Content on the Site is general in nature and does not constitute personal care, medical, financial or legal advice.
Elvana Care currently delivers services to clients with a Support at Home budget or legacy Home Care Package alongside their existing registered provider or care coordinator, and to private-pay clients. Elvana Care does not currently deliver CHSP-funded services.
2. Not a Substitute for Assessment or Advice
Information published on the Site is general in nature and is not a substitute for an individual assessment of your care needs, professional medical advice, or advice from My Aged Care. You should not rely solely on the Site when making decisions about your care.
3. Use of the Site
You agree to use the Site lawfully and not to:
- Submit false, misleading or fraudulent information through any form on the Site.
- Attempt to gain unauthorised access to the Site or its systems.
- Use the Site in a way that could damage, disable or impair it, or interfere with other users.
- Copy, reproduce or republish content from the Site for commercial purposes without our written consent.
4. Intellectual Property
All content on the Site, including text, graphics, logos and the Elvana Care name and branding, is owned by or licensed to Elvana Care and is protected by Australian copyright and trade mark law. You may view and print content for personal, non-commercial use only.

The Site may contain links to third-party websites, including My Aged Care and other government resources. These links are provided for convenience only. We do not control and are not responsible for the content or privacy practices of third-party sites.
6. Availability and Accuracy
We aim to keep the Site accurate and available, but we do not guarantee that the Site will be uninterrupted, error-free or continuously available. Content may be updated or removed without notice.
7. Limitation of Liability
To the extent permitted by law, Elvana Care excludes all liability for any loss or damage arising from use of, or inability to use, the Site. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

Our collection and handling of personal information through the Site is governed by our Privacy Policy.

These Terms are governed by the laws of the Australian Capital Territory, Australia, and you submit to the non-exclusive jurisdiction of its courts.
